By paying a deposit, you confirm that you have read and agreed to these terms, which apply to all guests on private charters.

To ensure a smooth and enjoyable experience, please review the following Terms and Conditions. By paying a deposit, you confirm that you have read and agreed to these terms, which apply to all guests on private charters.
1. Booking and Payment
1.1 Enquiries and Confirmation
Contact us to confirm available dates and receive recommendations for suitable boats for your planned charter.

1.2 Deposit

A 50% deposit is required to secure your booking

A secure payment link will be sent, valid for 3 days

If payment is not received within this period, the reservation may be released to another party

1.3 Final Balance

For day charters: The remaining 50% balance is due before boarding, payable via secure payment link or onboard by credit card

For overnight charters: The remaining 50% balance must be paid no later than 45 days before the departure date. Bookings made within 45 days of departure require full payment at the time of booking.
1.4 Late or Non-Payment
Late or non-payment of the balance may result in cancellation of your booking, with cancellation charges applied as per the policy below.

1.5 Payment Methods and Currency

All payments and refunds are made in Thai Baht (Thb) by secure credit card payment link (Visa/Mastercard) unless otherwise agreed in writing

Refunds will be processed within 5 business days via the same payment method used for the booking
2. Changes to Bookings
2.1 Minor Changes
Minor changes (such as guest names or small timing adjustments) are usually free, provided they do not affect our schedule.
2.2 Major Changes
Major changes that affect scheduling may be treated as cancellations and subject to applicable charges.
3. Cancellations and Refunds
3.1 Notice of Cancellation
All cancellations must be sent in writing by email. The date and time of receipt will determine applicable charges.

Day Charter Cancellations

More than 14 days before departure: 150 Euro administration fee

14 to 7 days before departure: 50% of the total charter fee

Less than 7 days before departure: 100% of the charter fee

Overnight Charter Cancellations

60 days or more before departure: 100 Euro administration fee
-
60 to 45 days before departure: 30% of the total charter fee
-
Less than 45 days before departure: 100% of the charter fee
3.2 Weather Cancellations (by Company)
If weather or sea conditions are deemed unsafe by the Thai Meteorology Department or the captain:

You will be offered an alternative charter date

If rescheduling is not possible, you will receive a full refund
3.3 Cancellations During Charter
No refunds will be provided for cancellations made by guests during the charter period.
4. Force Majeure
No compensation will be paid for cancellations or alterations caused by circumstances beyond our control, including but not limited to natural disasters, severe weather, pandemics, war, industrial disputes, and technical issues beyond reasonable prevention.
5. Safety and Conduct
5.1 Captain’s Authority
The captain has full discretion to change the route or itinerary for safety reasons. These decisions are final, and refunds will not be provided for such changes.

Guests must follow all safety instructions given by the crew

Failure to comply may result in termination of the charter without refund
5.3 Alcohol and Drugs
Intoxicated passengers pose a safety risk. The captain may deny access to activities or areas of the boat, or refuse boarding, at their discretion.
5.4 Children
Children under 18 must be accompanied and supervised by a parent or guardian at all times.
6. Liability and Responsibility

6.1 We accept no liability for:

Losses not caused by our breach of duty

Losses that were unforeseeable at the time of booking

Loss of personal belongings, especially valuables such as electronics or jewellery. Guests are advised to carry waterproof protection and ensure valuables are covered by personal insurance.
6.2 Guest Responsibility for Damage
Guests are responsible for any damage caused to the vessel or equipment due to negligence or misuse. Costs will be charged directly to the guest.
6.3 Health Conditions
Guests must inform us of any health conditions (including pregnancy) that could affect their ability to travel safely on a boat. We reserve the right to refuse boarding if safety is compromised.
